Health care proxy: Every person 18 years of age or older has a fundamental right to bodily integrity including the right to direct their own medical care and treatment. In Massachusetts, and many other states, the parent of a person over the age of 18 years of age, with very few limited exceptions, has no legal right or authority to make medical decisions for their 18 year old even if that person is unable to make decisions themselves. This is especially true with mental health issues and substance abuse issues. If you have not taken steps in advance and find yourself in the position where you need care or treatment but you are unable to give informed consent, you may become the subject of a guardianship petition at the probate Court.
